If you live in the United Kingdom, Bayer AG will provide the Services of MagicScout to you in accordance with these Terms of Use and the Privacy Policy.

This mobile application (hereinafter referred to as “app”) is provided by Bayer AG (hereinafter “us” or “we”). Additional information on the provider of the app is presented in our Imprint.

1 Handling of personal data

In the following, we would like to provide you with information on how we handle personal data generated when using this app. Unless indicated otherwise below, the legal basis for handling your personal data is the need for such handling to provide the functions of the app you are requesting (Art. 6(1)(b) General Data Protection Regulation).

1.1 Using the app

1.1.1 Communication with our app

To be able to provide you with the functions of the app, the following information is transmitted to us every time you use the app:

To protect our legitimate interests, we will store the aforementioned information for a limited time so that we can trace personal data in the event of unauthorized access or attempted access to our servers (Art. 6(1)(f) General Data Protection Regulation). We also store this data for troubleshooting purposes to ensure the stability and availability of the app.

1.1.2 Registration and login

If you would like to use certain services offered by our app, you will need to register with us. You must create an account in which you enter your personal login data to sign into the app. During registration and the sign-in process, we collect the following data about you:

• First and last name

We process this personal information to provide you with access to our app and the services it offers. If you deactivate your user account, this personal data will be deleted.

1.1.3 Using the newsletter

You have the opportunity in our app to subscribe to our newsletter to receive information about other products from our digital farming field. To send the newsletter, we collect and use the login details you entered when registering based on your previously given consent, Art. 6(1)(A) of the General Data Protection Regulation).

1.1.4 Using the functions

To allow you to use the services and functions of our app, we process your GPS data and pictures of your field or your plants if you send these to us. Based on the GPS position, specific image recognition algorithms are used that were trained for specific regions. This improves the user experience, since recognition of locally relevant species is improved, allowing our service to be adapted to the special local conditions at your location.

Your GPS position is also collected when an image is captured to allow individual observations to be grouped. Based on these GPS coordinates, several observations are thus assigned to a specific location on the map and displayed in a chronological sequence.

We may also process the email address you enter when registering in order so that we can send you important information about new versions and functions of the app.

Alongside providing the aforementioned services and functions, we also process the collected GPS data for the following additional business purposes of us and our Group companies (the latter are companies associated with us within the meaning of German stock corporation law). This subsequent processing of personal data is based on your prior consent (Art. 6(1)(a) General Data Protection Regulation):

1.1.5 Access to the interfaces on your device

To enable our app to function correctly, we need access to the following interfaces on your mobile device. These are used by us solely for the following purposes:

Location

Location information helps adapt and improve user experiences. This mainly includes the functions and services already mentioned, grouping individual observations, or using regional algorithms. In each case, we only collect reduced geolocation data with the last figure being deleted for anonymization.

Camera

Access to the camera is essential in order to be able to analyze, for example, specific pests in different pest traps or diseases and weeds on your field using image recognition algorithms.

Media

To be able to analyze any images you have taken with the smartphone, the app needs access to the gallery on your mobile device. This access is essential if you want to have locally stored images analyzed.

1.1.6 App analytics with Google

In our app, we use an app analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

We have authorized Google to analyze your use of our app. The purpose of this analysis is to optimize our app to serve the interests of our customers. The information collected by Google on your use of the app (e.g. the app content you retrieve, your language settings, the operating system you are using, your screen resolution etc.) is transmitted to a Google server in the United States, where it is stored and analyzed. The results are then made available to us in anonymized form. Your usage data will not be connected to your full IP address during this process. On our app, we have activated Google’s IP anonymizing function, which will delete the last 8 digits (type IPv4) or the last 80 bits (type IPv6) of your IP address after each data transfer to Google. By concluding special agreements with Google we also ensure that an adequate level of data protection is guaranteed with respect to the processing of personal data by Google in the United States.

We will then analyze your use of our app if you have given your consent the first time you accessed the app, or if you click on the top button to activate or deactivate app Analytics (Art. 6(1)(a) General Data Protection Regulation). You can also use this button to withdraw your consent at any time.

1.1.7 External services and content in our app

We incorporate outside services or content in our app. If we use such a service or if you are directed to third-party content, communication information must be exchanged between you and the respective provider for technical reasons.

It is possible that the provider of the respective services or content is also processing your personal data for its own additional purposes. We have therefore, to the best of our knowledge, configured the services or content of providers we know process personal data for their own purposes so that either communication for purposes other than the presentation of the content or services is deactivated in our app or communication occurs only if you have actively decided to use the service in question. However, since personal data collected and processed by third parties is not under our control, we cannot provide any binding information with regard to the purpose and scope of any such processing of your personal data.

1.2 Processing personal data at our request

We sometimes use specialized service providers to process your personal data. These are carefully selected and regularly monitored by us. They process personal data only at our request and in accordance with our instructions on the basis of corresponding orders and contract data processing agreements.

To analyze our usage data, we use the services of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.

To host our app and our services, we use the cloud services of Amazon Web Services, 410 Terry Ave North, Seattle, WA 98109-5210, United States. Your personal data is hosted on servers in Frankfurt, Germany.

In addition, our Group companies will also act at our request and according to our instructions as our contract data processor.

1.3 Processing of personal data outside the EU or EEA

The personal data will in part also be processed in countries outside the European Union (“EU”) or the European Economic Area (“EEA”) where the level of data protection may be lower than in Europe. In such cases, we will conclude specific agreements with our contractual partners (copy available on request), for example, to ensure that the statutory provisions in force here are observed, or we will ask for your explicit consent to any processing of the personal data.
